TERMS OF SERVICE

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Form Haus LLC, doing business as Form Haus (“Form Haus,” “we,” “our,” or “us”), governing your access to and use of our website, services, facilities, and booking platform.

By accessing our website, booking classes, purchasing memberships or services, or otherwise using our services, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you should discontinue use of our website and services immediately.

ACCOUNTS

In order to access certain features of our services, including booking classes and purchasing memberships, you may be required to create an account through our booking platform. When creating an account, you agree to provide accurate and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You may not use another person’s account without permission. You must notify Form Haus immediately of any unauthorized use of your account or breach of security.

ELIGIBILITY

Form Haus services are intended for individuals 18 years of age or older. Individuals between the ages of 15 and 17 may participate in classes only with the consent of a parent or legal guardian, including completion of all required studio waivers and documentation. Form Haus services are not intended for individuals under the age of 15.

STUDIO SERVICES

Form Haus offers Lagree fitness classes, memberships, class packages, private sessions, workshops, wellness services, and related offerings. All services are subject to availability and may be modified, suspended, or discontinued at any time. Classes and services are conducted primarily at the Form Haus studio location. From time to time, Form Haus may offer special events, workshops, or additional services.

MEMBERSHIPS

Form Haus may offer recurring monthly memberships that provide access to studio classes and other services. Monthly memberships require a minimum three (3) month commitment unless otherwise specified. After the initial commitment period, memberships continue on a month-to-month basis until cancelled. Cancellation requests must be submitted in writing. A minimum of thirty (30) days written notice is required to cancel any membership. Memberships will remain active and continue to be billed during the 30-day notice period. If the notice period extends beyond the next scheduled billing date, one additional payment may be processed before the membership is cancelled. Membership pricing, benefits, and availability may change at any time.

Membership classes must be used within the applicable billing cycle and do not roll over to future months unless otherwise specified. Form Haus reserves the right to approve or deny membership holds or suspensions at its sole discretion.

CLASS RESERVATIONS

All classes must be reserved in advance and prepaid. Clients are responsible for managing their reservations through the booking platform. Form Haus reserves the right to modify class schedules, instructors, and availability without prior notice.

CANCELLATION POLICY

Due to the limited capacity of our classes, Form Haus maintains a cancellation policy to ensure fair access for all clients. Class reservations must be cancelled at least eight (8) hours before the scheduled class start time. Clients with unlimited memberships who cancel within the 8-hour window will be charged a $20 late cancellation fee. Clients who do not attend a reserved class will be charged a $30 no-show fee. Clients using class-based memberships or class packages who cancel within the cancellation window or do not attend a reserved class will forfeit the class credit. All cancellation policies are strictly enforced.

WAITLIST

If a class is full, clients may join a waitlist. If a spot becomes available, clients may be automatically added to the class. Clients may be added from the waitlist up to two (2) hours before the scheduled class start time. If a client is added within the cancellation window, the late cancellation policy will still apply. For early morning classes, automatic waitlist additions may close earlier to prevent clients from being added overnight.

LATE ARRIVALS

Clients should arrive at least five (5) minutes before class begins. New clients must arrive 10–15 minutes prior to class to receive a safety introduction to the Megaformer. For safety reasons and to avoid disruption, clients arriving more than five (5) minutes after the class start time may not be permitted to participate.

STUDIO RULES

Grip socks are required for all classes for safety and hygiene purposes. Clients must notify instructors of any injuries, medical conditions, or physical limitations prior to participating in class and must follow all instructions provided by instructors and staff. Form Haus reserves the right to refuse service or remove any client from the studio if their behavior is unsafe, disruptive, or violates studio policies.

PAYMENTS

All purchases must be made using an approved payment method. Form Haus utilizes Stripe as its secure payment processing provider. By purchasing services, you authorize Form Haus and its payment processor to charge your payment method for applicable membership fees, purchases, cancellation fees, or other charges.

Clients are responsible for maintaining a valid payment method on file. Form Haus is not responsible for bank overdraft fees or other financial charges that may result from membership billing or cancellation fees. Clients agree to contact Form Haus directly regarding billing questions before initiating a chargeback or payment dispute. Form Haus reserves the right to suspend accounts or deny services to clients who initiate chargebacks for valid charges processed in accordance with these Terms.

REFUND POLICY

All class purchases, memberships, packages, and services are final sale and non-refundable. Unused retail merchandise will be accepted for a full refund within seven (7) days of purchase. After seven days, a store credit may be issued for up to thirty (30) days. No returns will be accepted without a valid receipt.

PERSONAL BELONGINGS

Form Haus is not responsible for the safekeeping of personal belongings while clients are present in the studio. Clients assume all risk of loss for personal property.

HEALTH AND SAFETY

Clients are strongly encouraged to consult a physician before beginning any exercise program. By participating in classes or other studio activities, clients acknowledge that physical exercise involves inherent risks, including the risk of injury or illness. Participation in Form Haus classes or services is voluntary and undertaken at the client’s own risk. Clients must follow all safety instructions provided by instructors and staff. Separate liability waivers and assumption-of-risk agreements may be required prior to participation in certain services or use of certain amenities.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Form Haus LLC, its owners, employees, instructors, contractors, and affiliates shall not be liable for any injury, illness, loss, or damage to persons or property arising from participation in any class, training program, or other studio activity, whether occurring in the studio or otherwise. Clients acknowledge that participation in physical exercise carries inherent risks and agree that Form Haus shall not be responsible for injuries or damages resulting from participation in its programs.

INTELLECTUAL PROPERTY

All content on the Form Haus website and related materials, including text, graphics, logos, images, branding, trademarks, service marks, and design elements (collectively, the “Content”), are the property of Form Haus LLC or its licensors and are protected by applicable copyright, trademark, and intellectual property laws.

The Form Haus name, logos, wordmarks, and branding are trademarks of Form Haus LLC, with trademark registration currently pending in the United States. These trademarks and trade dress may not be copied, reproduced, distributed, modified, imitated, or used in whole or in part without the prior written consent of Form Haus LLC. Unauthorized use of the Form Haus name or branding in connection with any product or service that may cause confusion or imply affiliation is strictly prohibited.

THIRD-PARTY SERVICES

Form Haus may utilize third-party providers to operate certain services, including booking platforms and payment processors. Form Haus is not responsible for the policies or practices of these third-party providers.

GOVERNING LAW

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

ARBITRATION

Any dispute arising out of or relating to these Terms of Service or the use of Form Haus services shall be resolved through binding arbitration in the State of New York.

ENTIRE AGREEMENT

These Terms of Service, together with the Form Haus Privacy Policy and any additional studio waivers or policies, constitute the entire agreement between you and Form Haus regarding the use of our services.

SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

CHANGES TO THESE TERMS

Form Haus reserves the right to update or modify these Terms at any time. Continued use of our services following any changes constitutes acceptance of the revised Terms.
